JNF PRESENTS MY ISRAEL PHOTO CONTEST

RULES AND REGULATIONS

 

Sponsor: The Sponsor of the Campaign is JNF (“JNF”).

 

Campaign Period: Submissions for the JNF photography contest (the “Campaign”) will be accepted online starting on Thursday, August 1, 2019 at 12:00 AM EST and ending on Sunday, September 1, 2019 at 12:01 AM EST. All online entries must be received by Sunday, September 1st at 12:01 AM EST. This is a skill-based content and chance plays no part in the determination of winners.  No purchase is necessary to enter or win.  A purchase does not increase the changes of winning.

 

Agreement to Rules: The information contained herein constitutes the official rules that govern this Campaign (“Official Rules”).  By submitting an entry, Campaign Entrant agrees to the Official Rules and warrants that their entry complies with all requirements as set forth by the Official Rules. Entrant further represents and warrants that they meet the eligibility requirements and agree to accept the decisions of JNF as final and binding as it relates to the content of this Campaign.

 

Eligibility: This Campaign is open only to those who follow / like JNF’s (Social Media) page, have a public (Social Media) profile and who are 18 years or older as of the date of entry. The Campaign is only open to legal residents of the United States and is void where prohibited by law. Employees of JNF, its affiliates, subsidiaries, advertising and promotion agencies, and suppliers, (collectively the “Employees”), and immediate family members and/or those living in the same household of Employees are not eligible to participate in the Campaign. The Campaign is subject to all applicable federal, state, and local laws and regulations. Void where prohibited.

 

To Enter: To enter, submit your original, unpublished photograph (the “Photo”) of Israel on (Social Media) tag JNF in the photo or comment section, using the hashtag: #MyIsraelPhoto AND #PoweredByJNF. Entrants are limited to submitting 1 Photos per person.

 

Photo Requirements: Each Entrant must comply with the following requirements (the “Photo Requirements”):

 

  • The Photo must, in its entirety, be a single work of original material taken by the Entrant;
  • The Photo may be cropped and rotated as necessary as long as the rectangular format is maintained and the file size is within the specifications above;
  • The Photo cannot incorporate added or replaced elements (e.g., no borders or frames may be added to the Photos);
  • The Photo cannot be an artwork or illustration or involve the doctoring that makes the Photo appear as an illustration;
  • The Photo cannot incorporate watermarks, signatures, or copyright notices;
  • The Photo must not contain material that violates or infringes another’s rights, including but not limited to privacy, publicity, or intellectual or property rights, or that constitutes copyright infringement;
  • The Photo must not, in the sole discretion of the JNF, contain material that is inappropriate, indecent, obscene, hateful, tortuous or defamatory; and
  • The Photo must not contain material that is unlawful, in violation of, or contrary to the laws or regulations in any state or country where the Photo was created.

JNF shall be the sole judge as to whether the Photo complies with these Photo Requirements.

 

Winner & Prizes: JNF shall identify three (3) winning Photos from amongst the pool of all submissions and shall rank them in order of First Place, Second Place and Third Place. Each Entrant is only entitled to win a maximum of one (1) prize. The Winner(s) of the Campaign (the “Winner”) shall receive:

 

  • 1st Place: Up to three nights at a 5-star hotel in Jerusalem for a twin room (includes breakfast, approximate retail value: $1,500; Photo submission shall be displayed at JNF’s 2019 National Conference
  • 2nd Place: Arrival and Departure Transfers to/from either Tel Aviv OR Jerusalem, including VIP service at Ben Gurion Airport, approximate retail value: $500; Photo submission shall be displayed at JNF’s 2019 National Conference
  • 3rd Place: Arrival Transfer from Ben Gurion Airport to either Tel Aviv OR Jerusalem, approximate retail value: $120; Photo submission shall be displayed at JNF’s 2019 National Conference

 

Actual and appraised value may differ at time of prize award and Entrant shall not receive the difference between the actual and approximate retail value of their prizes, if any. The specifics of the prize shall be solely determined by JNF. No cash or other prize substitution shall be permitted except at JNF’s discretion. If a prize is unavailable, JNF in its sole discretion, reserves the right to substitute the original prize with an alternative prize to the equal or greater monetary value and/or specifications, unless to do so would be prohibited by law. The prize is nontransferable. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of Winner. Entrant shall be responsible to complete tax and related prize paperwork as requested by JNF.  Failure to complete any such paperwork may result in JNF’s voiding Entrant’s right to a prize. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by Winner is permitted. Acceptance of prize constitutes permission for JNF to use Winner’s name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law.

 

Winner Selection and Notification: Winner will be selected by a panel of judges under the supervision of JNF. Winner will be notified by Facebook or Instagram direct message within five (5) days following selection of Winner. JNF shall have no liability for Winner’s failure to receive notices due to spam, junk e-mail or other security settings or for Winner’s provision of incorrect or otherwise non-functioning contact information. For the name of the winners, Entrants may send an email after September 1, 2019 to ksolka@jnf.org. If Winner cannot be contacted, is ineligible, fails to claim the prize within seven (7) days from the time award notification was sent, or fails to timely return a completed and executed declaration and release as required, the prize may be forfeited and an alternate Winner selected. Receipt by Winner of the prize offered in this Campaign is conditioned upon compliance with any and all federal, state, and local laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY WINNER (AT JEWISH NATIONAL FUND‘S SOLE DISCRETION) WILL RESULT IN WINNER’S DISQUALIFICATION AS WINNER OF THE CAMPAIGN, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

 

License: By entering the contest, each Entrant grants to JNF a worldwide, irrevocable, transferrable, sub-licensable, non-exclusive, perpetual, fully paid-up, royalty-free license to copy, reproduce, modify, excerpt, distribute, display (including publicly), adapt, publish, make derivative works, and otherwise use all submitted Photo(s), whether or not determined to be contest winners, in any and all ways, for commercial and non-commercial purposes, in any media now known or hereafter created, without further compensation and without restriction by Entrant or any other third party. JNF’s rights with regard to the license granted herein shall include but not be limited to, the right of JNF to: i) create derivative works which may incorporate the Photo(s), and register, in its name, copyrights with regard to any such derivative works; ii) publish and distribute the Photo(s) on JNF and JNF’s related entities’, websites, social media channels, and in other advertising and promotional materials; and iii) sub-license the use of the Photo(s) to JNF’s partners, affiliates, and related entities under the same terms as its license established herein.

 

Warranty By Entrant: By entering this content, Entrant represents and warrants that the Photo is an original work of authorship, and does not violate any third party’s copyrights, trademarks, moral rights, rights of privacy/publicity intellectual property rights of any person or entity, and that no other party has any right, title, claim or interest in the Photo. If a Photo submitted by an Entrant contains any material or elements that are not owned by the Entrant and/or which are subject to the rights of third parties, the Entrant is responsible for obtaining, prior to submission of the Photo, any and all releases and consents necessary to permit the use of the Photo by JNF in the manners set forth in these Official Rules without additional compensation.  If any person appearing in any Photo is under the age of majority, the signature of a parent or legal guardian is required on each release. Failure to obtain these rights and/or releases will result in Entrants disqualification at the sole discretion of JNF.

 

Publicity Release: By entering this content (e.g. photo, video, text, etc.), Entrants understand and agree that JNF, anyone acting on behalf of JNF, and JNF’s licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, Entrant’s submission, name, portrait, picture, voice, likeness, image, statements about the Campaign, and biographical information for news, publicity, information, trade, advertising, public relations, promotional purposes, (including JNF’s web site and social media channels) in all derivative works which may incorporate the Photo without any further compensation, notice, review, or consent, except where prohibited by law.

 

Indemnification: Each Entrant agrees to indemnify, exculpate and hold harmless, JNF, and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors (collectively, the “Released Parties”) from and against any and all claims, demands, damages costs liabilities, and causes of action of whatsoever nature, including, but not limited to, those that are based upon or arise out of: i) any breach by the Entrant of these Official Rules or any warranties made herein; or ii) personal injury, death or samage or loss of property, arising out of the Entrant’s participation in the Campaign or receipt or use/misuse of any prize.

 

Terms & Conditions: JNF reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Campaign should virus, bug, non-authorized human intervention, fraud, or other cause beyond JNF’s control corrupt or affect the administration, security, fairness, or proper conduct of the Campaign. In such case JNF may select the Winner from all eligible entries received prior to and/or after (if appropriate) the action taken by JNF. JNF reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Campaign or website or violates the Official Rules. JNF has the right, in its sole discretion, to maintain the integrity of the Campaign, to void votes for any reason, including, but not limited to: multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by Campaign rules; or the use of bots, macros, scripts, or other technical means for entering. Any attempt by an Entrant to deliberately damage any website or undermine the legitimate operation of the Campaign may be a violation of criminal and civil laws. Should such attempt be made, JNF reserves the right to seek damages to the fullest extent permitted by law. JNF reserves the right to verify the validity and originality of any entry and/or Entrant (including Entrant’s identity and address), and to disqualify any Entrant who submits an entry that is not in accordance with these Official Rules. Failure of JNF to enforce any of its rights at any stage does not constitute a waiver of any rights JNF has under these Official Rules or under the law. JNF further reserves the right to interpret these Official Rules as needed and its decisions are final.  JNF reserves the right to correct typographical, clerical, or printing errors in any contest materials.

 

Disputes: Entrants agree that this Campaign shall be GOVERNED BY THE LAWS OF THE COUNTY AND STATE OF NEW YORK. To the extent permitted by law, the right to litigate, to seek injunctive relief, or to make any other recourse to judicial or any other procedure in case of disputes or claims resulting from or in connection with this Campaign are hereby excluded and Entrants expressly waive any and all such rights.

 

By participating, Entrants also agree: i) to be bound by these Official Rules; ii) that the decisions of JNF are final and binding with respect to all matters relating to the Contest; and iii) JNF shall not be under any obligation to make use of any of the rights granted by Entrant herein with regard to submitted Photos.
